Hello

Like to say hello to all readers. First post.

I'm a US citizen by birth married and living at Colombia for 19 months now. I have colombian conjugal visa.

Planning to do Consular filling. The question is when is it decided CR vs IR?

The 130 approval date, Embassy interview date or USA Port entry date.

Read a bit thru the forum hope not reasking a previous post.

I tweeked this information from a previous VJ post.

USCIS will figure it out which class you are belonging to...

IR1 stands for Immediate Relative type.

If you married to the same person for more than 2 years when you get interviewed, it will be considered as IR-1 and they will give permanent resident card (I-551) with 10 year validity.

If you married with less than 2 years for same person when you get interviewed, they will issue Conditional permanent resident card with 2 year validity marked as CR-1.

Ultimately, it's the POE date for IR-1 consideration, but must hand carry the marriage certificate, show it to a CBP shift supervisor, ask for IR-1 designation to be put into the computer. They'll do it, you have to ask, it's not automatic.

Penultimately, can also get IR-1 designation on interview day.

Mostly, all of this stuff depends on your calendar. Calendar starts on your marriage date, not yer first date in Country.
