Hi VJ friends!

I am hoping someone can educate me... My Fiance and I just completed our interview in the Bahamas last week Wednesday. We were basically told they need to review our case further and requested more information from my fiance. He asked if once he gets the documents they requested if he can bring them in, he was told no - wait till we call you. My concern here is that my I-129F petition for my fiance expires June 24, 2011. That is 3 weeks away!! :wow: I would think that the consulate would extend the petition being that they are still reviewing, but you know what they say when you assume. Does anyone know how I can find out if the embassy will just let it expire with USCIS, or will they extend the date? I consulted an attorney yesterday and he told me that they would probably let it expire - but I don't know if he was just saying that so I would retain him...

Any help/info is GREATLY appreciated!!

She already had the interview the petition is not going to expire. The embassy/consul extends it until a decision is made.

It is a non-issue.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

dont worry about it dear.we are on the same boat hehehe.i was interviewed last may 24,2011..7 days before the I-129F expires.

the consul told me that our visa is approved but in order for them to complete the process for our visa i need have to submit an nbi that has an aka thing.and hummmm my name got hit at the nbi and they told me that my clearance will be released on the 17th of june.on which as of my fiancee's timetable..that 17th should be the released of our visa.it sucks though bcoz my fiancee is ready to buy our ticket and yet still waiting on the nbi and then i dont know how many days will i wait for our visa when i send my nbi and our passports.

the consul given me this 221g form.and he checked the need have to send both passports and nbi to the embassy then will wait 2weeks for my visa.

As Inky posted above, it is a non-issue. The 4 month petition validity is the time during which your fiance should have the interview. Since that already happened, there should be no problems there. Just in case, if they ask you to submit additional evidence, I would submit a letter stating that nothing has changed since the time that you submitted your petition and that you and your fiance still remain eligible and have intentions to marry once your fiance comes to the U.S.

Thank you all for taking the time to respond back and give me hope. I will FedEx a notarized letter down to my Fiance in the Bahamas so when they call him back, he can submit my letter as well. I really appreciate the advice. I hope this AP doesn't take to long, I miss my love! Good Luck to you all as well. Thanks again!
