some doubts about entering the US with my tourist visa

Hey there to all!!

I am from Mexico, my soon to be husband and i have some concerns, that maybe you guys know something about it. My fiance is a born US citizen, he live is Wisconsin, i live in Mexico, i have always have tourist visa, never been denied one, thanks god!! And i we want to know if i am able to visit him in Wisconsin this June, We just send the first form to Texas to received the package with the forms to apply for the K1 at the end of this summer ¨supposedly at the end of this summer¨ and i bought already my plane tickets for visiting him and we did not stop to think that if we fill in this form, i will have problems going in the us with my tourist visa, by any chance any one knows if it will be better for me to canceled this trip and not go? I just don´t want to do something that could be wrong for us, with out knowing, because when we fill on the form there was no notes , saying after you apply if alien has a tourist visa, he*/she wont be able to use it. Any one of you know please let us know.

Another good thing to carry with you just in case (but you don't need to bring it up unless they ask) is your NOA1 from USCIS. That way, you can show that you are going through the immigration process legally and properly if it comes up.

No problem! I'm sure a copy of the NOA1 will be fine, if it's easier for him to scan and email it to you. You don't need to bring the originals.

And thanks! I'm going through a different process because we're already married, but we're getting close to the end!

We were advised by a lawyer that helped us gather our documents (we didn't know about VJ at the time) that it was a better idea not to go, which we didn't like because I was planning to visit him in January, since he had come to Mexico twice already. But he visited agan. I have also read here some people saying if you can wait, then wait, and welcome your loved one in your country. We did it because we absolutely, as you say, wanted to put no risk on our process, so he came. But it makes sense that if you are going, take evidence that shows that you are coming back. I think it's silly because if you wanted to stay there, why would you want to get a K1 visa, right? Best luck with whatever you decide to do :)

The only risk you face is being turned away at the border (so basically, the cost of a plane ticket and a broken heart). If that does happen, it will not affect your petition/application. In my opinion, as long as you have a return ticket and can demonstrate that you have the funds to support yourself while visiting, strong ties to your country, and any other evidence that you plan to return, it shouldn't be too difficult.

My husband did end up coming just as we were between the USCIS and NVC stages, he stayed for almost two and a half months, and it was absolutely wonderful. I don't think I would have been able to make it without the visits (it's been over nine months since we started the process).

I went to visit my fiance twice when we were waiting our NOA2 the first one in thankgiving for 5 days,the just asked who I was gonna visit and I said my novio y amigos, the conversation was in spanish and she asked me for how long and I showed to her my return ticket and that was all. and the second time I was supposed to stay just for 2 weeks I ended up staying for 2 months, the office joked with me saying you have a permise until july but you dont have to stay jaja, I went to my interview and the consul asked me when was the last time I was in Usa I told her injunuary for two months and I showed her my turist visa she said good and kept it, I got my fiancee visa!

I think we some how messed up on the PETITION for the I-29 or what ever name it is...Because we did not make a letter, just like a read on the guide here, or gather evidence about our relation ship, that we do have them ,lots an lots of txt messages and phone conversation , facebook, we do have plenty of photos,but no letter afraid, hahahaha, i don´t know if that petition he send will be good for us, i mean obviously they are going to rejected , but i am wondering if this is going to be bad on our process of getting the approval for K1? i want to think that the worse that can happen is that we will have to do the petition again and fill in the letters and all that stuff. You guys Mexico do yo recommend to get married by the law on the US, or do you think it will be faster for us if we get married by the law on MEXICO and then asked for the K1?

I don't know too much about the K-1/I-129F process so I'm definitely not an expert, but as far as I know, all of that stuff is optional (cover letter, evidence of your relationship, etc.), although most people do like to include some evidence to make their case stronger. Just because you didn't send all of that extra evidence in, it doesn't mean your petition will automatically be denied. You might receive an RFE (request for evidence) if you forgot anything important, or who knows, you might get approved just fine. If you do, you can always bring lots of extra evidence to the interview when it gets to that stage.
