Timeline

My I485 was accepted on Mar, 28, 2011. However, the time processing for Atlanta, GA field office showed that it is only processing case at August, 2010. Before I got green card based on I-485 family base, my OPT will expire in August. As a result, I decided to renew my EAD card by filing I-765. However, my major (Forestry Science) does not allow me to renew my OPT under the same category. Or USCIS will issue me a new EAD. Any suggestions on that from experts? Many thanks.

If I understand you correctly, you originally came as an F1, applied for OPT and your OPT period is up in August.

You've since gotten married to a USC, or a family member has petitioned for you, and you have an AOS case pendign with USCIS.

Correct so far?

Did you fill out the I-765 application for employment authorization with your AOS? If you did, you should receive the EAD from that within 90 days of the AOS submission, meaning by the end of June.

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

You are absolutely right.

I did not file my I-765 with my AOS since I thought 5 months were enough to get my green card. But now it looks not true. So I have to apply or renew another EAD. Should I say "renew" on I-765? Many thanks.

I saw your case, and field office in NYC shows that they are only processing case in Sep 2011. But how is your case so fast according to your timeline? Within a month, you already got your biometrics done. But I have not received any thing within over a month.

It is fairly common to get the NOA and biometrics appointment letter within 4-8 weeks from submitting the AOS package, and then wait around for the interview appointment for months, especially for people who are in NYC area.

You said your case got "accepted" on Marcg 28th - I assume that means that is the day you got your NOA / the date that was on the NOA?

The timelines for different people vary quite a bit. You should be posting in the AOS from tourist, work, student visa -forum, since you are doing the AOS process, not applying for a student or a tourist visa.. you will get more replies there, and you can see how other people's cases are progressing.
