My USC husband is having a problem of finding a joint sponsor when his brother committed to be our joint sponsor but had turned around and refused. Actually our AOS Fee Bill was paid. For now, I, beneficiary, cannot think of anyone to replace him.

Here is a little bit of his work background (the most recent tax years)

My husband got laid off work in Sept 2008 so he drew unemployment money for the maximum period. I guess his unemployment money ended in the middle of 2009. So basically, he didn’t have a job in 2009. Then starting 2010, he got a part-time job in January and was promoted to a permanent management position in July until now (Apr 2011). This way, his income is higher than the 125% poverty guidelines…

So my question is

- Can he submit I-864 without joint sponsor?

- If he cannot really find a joint sponsor, can he write the letter stating why he didn’t have a stable work history and it is affecting his financial status that it doesn’t mean he didn’t make much

- Additionally, can his letter of employment and pay stub the last 6 months or even back in July 2010 until now replace the joint sponsor paperwork?

- Or…can his employer write a letter stating his annual expected income that is certainly higher than poverty guidelines for the year of 2011 and later on?

Current and continuing income is what is important. If his annualized income meets the requirement then no joint sponsor would be needed. That income would be documented by recent pay stubs and an employer letter.

yes he can, if his current financial situation is over the poverty line and you have the documentation to prove, such a paystubs then you dont need the joint sponsor.

All he will need to do is write the letter and explain the situation or better you might want to call USCIS and check what you need to do to replace the joint sponsor as now you dont joint sponsor anymore.
