Hi,

I am half way through the process of getting my K1 to move to the States to marry my other half. I still have a court battle to go through to ensure I can take my daughter, who lives with me, out of the Country. Has anyone else been through this before leaving? Do you have any advice?

Yes. We did. We finished it before we filed the petition. When children are involved you put them FIRST and the adults do not do anything until everything is assured for the sake of the children. Hopefully your court situation will be resolved beforehand, but if not you can ask for postponements of your interview for up to one year at most consulates.

I forgot to mention - it was all agreed by both sides that no one was worried about the move - hence putting the visa in motion - it is only now he has decided he is against it. It is a very tricky situation, as he is not a nice man and I have a restraining order, but he still see's my daughter. Ahh - just a scary when thinking about the courts :(

I can understand what you are going through. I was originally going to move to Manchester England to be with my sweetheart and take my daughter, it was confirmed so about a month before the move I sold everything I owned - EVERYTHING and got everything boxed up, but then my ex decided to change his mind (specifically after he knew I sold everything) and not let my daughter go or even visit. So we went the K1 visa route to bring my sweetheart here.

I really hope it all works out. :blush:

K1 PROCESS:

11/1/10: NOA1 Received

4/14/11: NOA2 - Approved!!!!

8/18/11: Visa in hand

8/29/11: POE in ATLANTA!!!!

9/16/11: Married!!!

AOS PROCESS:

10/4/11: Social Security Card Arrived!

11/10/11: AOS Package mailed to Chicago Lockbox

11/19/11: NOA1

12/2/11: Biometrics

12/10/11: Case transferred to the California Service Center

03/06/12: EAD approved and card production!

03/14/12: EAD card in hand!

08/04/12: Green card in production!

08/09/12: Green card in hand!

Yes, needless to say I am worried sick. At least at the moment time seems to be on our side, I hope! :)

Now we are just waiting to see what happens - we got the NOA2 in, approved, but then an email saying the USCIS were reviewing again. AHHH. Should all be fine though - PMA is the name of the game, otherwise we would go nuts ;)

He has no parental rights, as she was born before 2006 - but obv he can take it too court - I just hope the courts agree with us. He is a loser - 42, no job, lives with his gran. I work, study and do everything myself - my SO is nearly a WO in the American Army, so fingers crossed.
