A couple questions, looking for a little help. They all pertain to question #4 - the residency requirements for CR-1:

1. Once a CR-1 has been granted, must the beneficiary live in the US for the entire two years?

2. Can that person travel abroad and still enter the country?

3. Can that person live abroad and still proceed to the permanent green card two years later?

4. What are the residency requirements for the CR-1?

8 August 2009 - Met

21 October 2009 - Started dating

18 August 2010 - Engaged

22 January 2011 - Married

15 March 2011 - Filed I-130

22 March 2011 - NOA-1

read the guide to remove conditions,you can traval with your permanent resident card,you can live outside the us 6 months over one year is abandon ment of your resident,you need to show you file taxes, live here, banking, lease, when the time comes for you to remove conditions you could have a problems. read the guides,

1) Green-card is for residing in the USA on a permanent basis, can travel abroad, however if it is determined that not residing in the USA, the green-card can be revoked.

2) Yes, travel is fine.

3) Yes, and No. Yes if living abroad has to do with work for US Government, as in military service. No if living abroad is for other reasons.

4) Same as any other green-card. Permanent residency in the USA.

Maintaining Permanent Residence

You may lose your permanent resident status (green card) if you commit an act that makes you removable from the United States under the law, as described in Section 237 or 212 of the Immigration and Nationality Act (INA) (see the “INA” link to the right). If you commit such an act, you may be brought before an immigration court to determine your right to remain a permanent resident.

Abandoning Permanent Resident Status

You may be found to have abandoned your permanent resident status if you:

  • Move to another country intending to live there permanently
  • Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa. However, in determining whether your status has been abandoned, any length of absence from the United States may be considered, even if less than 1 year
  • Remain outside of the United States for more than 2 years after issuance of a reentry permit without obtaining a returning resident visa. However, in determining whether your status has been abandoned any length of absence from the United States may be considered, even if less than 1 year
  • Fail to file income tax returns while living outside of the United States for any period
  • Declare yourself a “nonimmigrant” on your tax returns
