Montreal I-601 Waiver Process

Timeline

My I-130 was just approved yesterday. My husband and I know we still have a long journey ahead of us. When I go for my Visa interview in Montreal, I know it will be denied and then I'm to file the I-601 while I'm there. Then wait and wait again as I've seen Montreal is really slow. However, my question is: will I have to go back to Montreal for a 2nd interview at some point? As well as get another medical and police report? Thanks for any input.

The second medical and police report would depend on how quickly yours are going to expire and how long Montreal drags out the process for you. Iv seen a couple people have to get new police reports and medicals because Montreal took so long but even after sending thos in with the passport they are STILL waiting to get the passports back.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Make sure you have it clearly spelled out that you need the I601 Montreal at the first interview. Montreal has in the past held onto paperwork and waited a couple months to notify the beneficiary of the inelgibility. If you know exactly what the section of INA that spells out the ineligibility all the better have it typed up and at the top of the I601 to "help" the consular officer along. Be prepared with a complete well documented I601 packet and have the beneficiary insist on filing it and paying the correct fees for it. If your case also needs an I212 make sure that is included and paid for too. There are two separate fees for this.

If the consular officer you are dealing with doesn't seem to "get it" have the beneficiary ask for a supervisor to explain the situation so you don't have your packet waiting in a pile somewhere killing time in your process.

Ask for a copy of the receipt or the document with the ineligibility, and hang on to it. Ask when they plan to send it on to VSC for you and then followup to make sure that is done.

Unless they insist on a second I601 interview which happens in some consulates, try very hard to file the I601 the same day even if this is the case in Montreal.
