Hello Guys,

As i indicated in my last post that USCIS have issued another RFE.

I have recieved it yesterday.

Now, They are asking my(beneficiary/intending immigrant) tax return because i have showed my projected annual income on line item 24b of i-864 form.

Here is the situation :( ...

I graduated in May 2010 and got my 1st job in November 2010.

I have showed my projected annual income with my employment letter to the USCIS as proof.

The RFE (Number 2) states in handwritten text that " the household member (my name in handwritten) on the petitioner/sponsor's form I-864,affidavit of support,must submit the fedral income tax return submitted to the IRS for the most recent tax year (Form 1040 in hand written)"

Also, in handwritten on the bottom of this paragraph says " household member reports $x income".

My OPT expired in February 21 and then i have grace period to work.

MY company can wait for me untill my EAD arrives so that i can join back.

I filed all years tax return for $0 income and income for 2010 Tax return but it has only one pay period.

My question is should i send all the tax return i have filed so far and tell them as well that i will go back to the job as soon as my EAD arrives.

I am really confused and sad regarding this because my case is being delayed.

Please advise, If i should attach the following documents:

-2007-2009 $0 income tax return.

- 2010 tax return which i just filed if possible i will see if i can find the transcript otherwise i will send the copy i have sent to IRS.

- written letter stating my situation that 'i graduated in may 2010 and i landed on my first job in Nov 2010 and my wife graduated in 2010 and she got her first job in Jan 2011.

- my pay stubs from Nov untill february.

- Copy of My degree stating my graduation year as a proof.(also it might help to show that finding a job wont be a big challenge)

They told you

Is "-2007-2009 $0 income tax return" the most recent tax year?

2009 will be the most recent tax year as per the last RFE but they also have indicated that ' i reported $x amount' which is reported on the 2010 return and IRS submitted few weeks ago and transcript is not available yet.

There is a conflict.....

Please adivse if i should attach other documents besides 2009 tax return such as copy of the 2010 tax return submitted to IRS and paystubs from Nov untill Feb and my Degree.

Apreciate your help.

i reported $x amount' which is reported on the 2010 return and IRS submitted few weeks ago and transcript is not available yet.

You have submitted 2010 so that is your latest tax return. A transcript is just one option. A full, signed photocopy of the tax return plus W2 statements from any employers is also accepted. Think about this-- why would sending a 2009 tax return with no income help your case if you've got a more recent one?

Send them your latest tax information like they asked. Anything else you may want to include that helps prove your income is optional.

Think about this-- why would sending a 2009 tax return with no income help your case if you've got a more recent one?

Send them your latest tax information like they asked. Anything else you may want to include that helps prove your income is optional.

sending the copy of 2010 return which is not yet recieved by the IRS will be fine?

because i have not sent my wife's Employment letter initially and also with her RFE should i send her employment letter & pay stubs untill now with my RFE documents.

Follwing are the documents i am thinking of attaching please advise:

• Copy of Original I-864, Affidavit of Support, filled out by my Sponsor (Petitioner),

Wife.

• Copy of 2010 Tax Return, Form W-2 and Form-1099 submitted to Internal Revenue Service.

• Copy of Pay stubs from November 2010 to February 2011.

• Letter of declaration stating that '

My Application i765 has been accepted and card order/production updated on the USCIS site.

I485 status is not updated yet but i am assuming as i765 and i485 are related therefore it is also approved/accepted.

Thanks a lot guys for your help and imperative advise.

Will post you after knowing the status of I485 and I130 applications.

Approved I-765 does not mean approved I-485. EAD is in interim benefit granted while they continue adjudicating the I-485. Approval of the first, does not guarantee approval of the second, nor give any indication of when they will make a decision on the I-485.
