Hello! Could someone help me understand what is my official status called after the AOS application was sent but before the GC was approved? AOS is from F-1 (F-1 visa still valid through the end of June).

If I had to indicate my official status on an official form, could I still say that I'm in the 'non-immigrant visa' status now?

AOS from F1

February 18, 2011 - sent via FedEx

Feb.19, 2011 - delivered to Chicago Lockbox

Feb. 28, 2011 - NOAs received

March, 2011 - biometrics letter received, biometrics completed

April, 2011 - Employment card arrived

June, 2011 - Interview notice for July interview

July, 2011 - Interview successful - GC received

"Applicant awaiting adjustment of status".

You would still be under the F-1 - but your in the process of adjustment.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

this coming from a long time F1 Student!

you will still be an F-1 Student even if the whole AOS process takes 5 years, until/unless your AOS (485) is approved you're an F1.

AOS pending is not exactly a status, (just an indicator of an pending process/application).

so i'd say keep your status until you're approved, but at the same time, it wouldn't really matter since you'll have an AOS pending

Thank you! I'm inviting my parents to the graduation and in the application for the visa they need to indicate my current status in the US. And I wasn't sure if 'non-immigrant visa' would still apply. Thank you for the explanations!

hmmm odd... my immigration attorney advice I got when having my forms proof-read was to fill out the field as "AOS applicant" (former F-1 myself). He explained it to me that once you file for AOS you will lose your status as a non-immigrant visa holder as you want to adjust that current status into a permanent resident one.

Either way though it's not a "dealbreaker" if you fill out this field "wrong". If there is any clarification needed it can and will be discussed at the interview and if the IO thinks it needs to be changed they can do it right there and then which you then have to sign, initial to make it official.

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done
