I talked to friend of mine yesterday that has a k1 pending and is now 6m 27 days waiting in VSC. He called once again for service request and was told they are working on sept 11 dates.. His was a sept 2 date, and according to them it will not be 30 days overdue until they began processing oct 2 dates, which sounds ok at face value, but when you think about it sometimes they may spend several days or a wek or so on a particular day. If this is true then by the time they get to the oct 2 petitions, the actual day could really be 1 or 2 months further out than the day they are actually working on.

If this is true, then now we know why so many are past the 30 days but uscis only counts the actual days they are working on as the late date. This sucks big time! Anyone heard of anything similiar?

i got a similar response when I called. I was told they were working on sept 11 petitions as well so I could not be outside of normal processing times until 30 days after they start processing October petitions which if they keep moving is another two months. Its what they use to quell the situation and keep people waiting because they are slow. They just keep pushing out the date so u can't call back or if you do call back, they are not required to look into your petition.

The bummer is that they only update the date they are "working on" ONCE A MONTH on the 14th or so of each month. So they will be "working on sept 11th" until April 14. Just like they worked on "august 21" until March 14 and "july 24" until February 14. So according to them, your friend would not be outside normal processing times until may 14, when presumably they will be "working on" petitions in the beginning of Oct.

BUT so not despair - all this really means is that you won't get the tier 1 monkeys on the phone to help you for quite some time so it is necessary for you go another route. Talk to your congressman. And your senators. Sometimes they don't jump in at 5 months, but if it's after 6 months - and indeed if it's 7 months - then they are MUCH more likely to help you. Good luck!

Ok thanks guys. Well as of this post i am on my way to LA then on to Philippines to visit fiancee again for 10 dsys and her graduation from college. Maybe this visit will tie me over til k1 is done at VSC. I am at 5 months on april 5.
