I have applied for a K1 visa in the month of December 2010, I have also received the first notification.

But today i found out that the 212e status in my previous J1 visa requires me to stay in India for 2 years before i can get an immigrant visa like K1.

I am so confused. Some websites imply that i need a waiver only if i am still in the States and want to change the visa status but some sources tell me that I need one regardless unless the two year term is over.I am now in a fix because my American fiance and I have already applied for the K1 visa and also notified family and friends about our marriage. What do i do now and how and where do i obtain a waiver from?Somebody please help!

Contact your Ministry of Foreign Affairs in India to see how to obtain the waiver. Then, follow up with the State Department.
