How to bring step son to America

Timeline

My wife and I finally convinced her ex to give custody of 13 year old son to her, to allow him to come to US. Can anyone please explain ouptions and process to use?

She came in on a K-1 in December 2009, married same month. Now 14 months later, so "follow" option is not applicable if I read correctly? Do I apply for him? Does she? Does she need to wait until "conditions" are removed in 2012? What is our best process.

Also, in China now for two more days. I assume we need certified documents to show custody? Son's birth certificate? What else should we obtain while here? Time is limited, so we want to cover all issues possible this trip.

Yep, you the step parent can file an I-130 for step child, your marriage took place before step child's 18th birthday.

Start here: http://www.visajourney.com/content/childpet

You will be filing I-130 for your step child, and as evidence will attach proof of citizenship, copy of child's birth cert+ English translation, copy of marriage cert, MORE explained at link above.
