My boyfriends 751 was denied. We plan on resubmitting another one in the next few weeks after we get more evidence. He currently has an i-551 that will expire soon and has not received a NTA yet. We plan on making an infopass appt to get a new i-551 before this one expires.

My question is can he travel out of the country with just his i-551 while we await a decision on his resubmitted i-751? Is he considered to be in removal proceedings even if he has another i-751 pending petition?

Moving this to Removal of Conditions forum..

I would not make any trips out of the country until after resolving the situation with the denied I-751.

Insufficient evidence of a good-faith marriage?? Boyfriend?? Divorce? Separated?

The ROC process establishes if the resident does become an unconditional resident, which is the default, or whether or not his residency should be canceled. I the I-751 was denied, that means USCIS will automatically initiate removal proceedings against him. This will mean a day in court. I don't understand what submitting another I-751 should accomplish.

The only option I see is for your BF's lawyer to ask the judge to put the removal proceedings on hold until the divorce is final. I'm not sure how long the court is willing to wait for this, but I think that's his one and only shot.
