Correct..or have been physical present in the us for the min of 18mths (3 yr rule) or 30 mths (5 yr rule) of being a P.R

Your tax returns are very important proof that you are eligible for naturalization. "On the day of your interview", bring certified tax returns for the last 5 years (3 years if you are married to a U.S. citizen). Certified tax transcripts may be ordered by using Internal Revenue Service (IRS) Form 4506-T available at

www.irs.govor calling 1-800-829-1040.

Saw nothing about sending in tax returns on the five year, stepdaughters application was accepted without those, but she has four years of transcripts, told her to bring those in, just four pieces of paper, just in case. She came home yesterday, went over her W-2 and 1099, she can get 30 bucks back and for her, that is a lot of money, so we will file, but said we can forget about her savings account where she earned 20 cents. Can round off to the nearest dollar, so shouldn't be a problem. Going to college with just part time jobs, tees me off, we can only deduct $4,000 for her tuition when we laid out over $14,000.00. Always feel I we are getting screwed by the government, and what services? Moving all the snow from the road into my driveway is a service I can live without.

According to the IRS regulations, she does not have to file with that low income, so if she doesn't, she is NOT failing to file. But we have two reasons to file, keep the USCIS happy and for her to get 30 bucks back.

I am preparing my N400 application on a 3 year marriage based rule... I arrived in U.S. on Nov-2008 didn't file taxes that year. so now i just have tax return for 2009 and 2010. do they have to have 3 years ?

You are not eligible........yet. You have to wait until you are within 90 days of your 3 year anniversary IN ARRIVING TO THE US.

Better straighten out your taxes. If your spouse was able to provide an affidavit of support, he/she should have filed joint status. He/she lost money filing single if they did file.
