we filed for our AOS by the end of October... that's why we consider ourselves more of a November 2010 filer.

after I got my biometrics done last December 2, 2010... I received an RFE 2 weeks after.

Since we had a flight to North Carolina... we couldn't send them the RFE right away.

3 weeks later we got back in Florida... sent them RFE letter along with the evidence last January 18, 2011... after Martin Luther King, Jr. day!

Just today, January 24, 2011, I saw a touch on the USCIS website for my AOS for permanent residency/green card.

No touches on my EAD application. :(

so here are my questions, that i hope somebody can enlighten me on these:

1. Does this mean that they're not working on my EAD?

2. How much toll will this RFE put on the processing time?

3. Basing on my current timeline... can someone give me an estimate on how long or when I can get the EAD at least?

I can't wait to get my id from the DMV.. and my driver's license too

Thank you in advance!!

Advance Happy Chinese New Year! :)

1. No. Status updates for AOS/EAD/AP are not reliable. Many people receive their EADs, APs and even their Green Cards without the cases ever having been 'touched' on the USCIS website.

2. Hard to say, but once they have accepted your RFE they should resume processing of your case as normal, so probably the only delay will be the time it took you to return the RFE and the time it took USCIS to accept it.

3. Your current timeline gives you an estimate, so noone will be able to improve on that, but it varies from case to case. You are past your estimated approval time but still within the processing times published by USCIS. It could be any day :) but if you still haven't received your EAD after 90 days you should make an Infopass appointment at your local USCIS office and they should issue you a temporary EAD.

Also, count yourself lucky - I also returned an RFE on the 18th and no touches so far ;) Good luck - it's coming, but there's no doubt it's a very frustrating wait!
