New & have some very important question

hello everyone. i am very new here and just found this website today. for the past 3hours i have read alot of informations that is indeed very helpful. Bu i still have some questions to ask, hoping that someone haven gone thru the same situation and can possibly give us some clarification on this matter.

My sister just got her K1 approved and now waiting for her interview at USEM. she have a 16 year old son. she and her fiance listed him at their application form as defendant. originally they plan to bring him with her to US. but since my nephew is still in school and now graduating in high school, my sister doesnt wanna ruin his school year. besides the kid has good grades in school and plan to take a scholarship exam at PUP and wants to take up industrial engineering. my sister says, that if he flies with her now, most probably he will have to get a job as they both dont wanna be a burden to her fiance and besides college in US is way very far expensive and they plan to send him to join the navy when he turns 18 to get a free college. now, theyre considering of letting him stay behind, take the scholarship and study college and when he finish they will petition him to come to US. if its after 2 years he then turns 18, if 4years to finish his college he then turns 20 which still falls the age under 21.

now the question is, do you think their plan is good and practically reasonable like we think? do you think this will make the consul not to issue my sister her visa?

please share your thoughts and advice for possible scenario and if you know any helpful way to do this.

She could do a K-2 to follow, have him come here for the summer, adjust status and go back for his education. We did that and are doing that with our son. He goes to college in Moscow.

OR her husband can file a CR-2 for him until he is age 21 and IF he marries your sister before the boy turns age 18.

it has nothing to do with your sisters visa.

She could do a K-2 to follow, have him come here for the summer, adjust status and go back for his education. We did that and are doing that with our son. He goes to college in Moscow.

Sergey came on a K-2 to follow in June 2009 and we filed for his AOS the day after he arrived. He got his green card 3 days before he went back to school, but he had an AP in case his green card didn't get here in time. He came back this summer and is now back in Russia at school. He has a Vermont drivers license and had a job and will file taxes this year. He will come back again this summer and return to start his masters program in the fall. There are a few details to maintian his residency bu ####### is not difficult at all, really.

thank you so much for the info, this is really helpful. leads me for some follow up questions, how long it took when you filed for k2 to follow, and when he got there how long is the AOS process before he got his green card?

The K-2 is included in the I-129f petition so there is no other petition to file. You contact the consulat eand make an interview appointment, whatever the procedure is for manila, you follow that.

I worked with the local USCIS to expedite his AOS, your local office could do the same. We filed his AOS the day after he arrived and when the receipt came we took it to the local office, got his biometrics done and they processed an "emergency" AP request. He had his AP about 10 days later. The local office also called the national benefits center and requested hs AOS file be forwarded to them immediately. He did not need an interview, K-2s usually do not. He had his green card in 7 weeks from when we filed. He could have left the country about 3 weeks from when he filed with his AP.

Remember...Alla already had her green card. K-2s are derivitive of K-1s. Your sister MUST have her green card before he gets his (or it can be done at the same time but will take MUCH longer) So your sister needs to get here, get her AOS filed, get her green card and THEN file for her son if she is going to do this. The K-2 MUST be issued within 12 months of her k-1, so there should be no delays in her filing AOS, she needs to do it as soon as possible. I highly recommend doing this how we did, it was very easy and much easier than going through another visa process BUT it takes very careful coordination and planning and there can be no delays. Alla arrived and we got married within 8 days and sent the AOS within a month. I had all of Sergey's AOS papers ready when he arrived, all I needed was a copy of his entry stamp and I-94 card. I literally was at the post office the next morning at 8 am. I would have sent it the day he arrived but the post office was already closed when his plane arrived. You have to have a plan, it needs to be closely followed. You have to plan for when the interview will happen. Sergey had his visa interview 2 days after his last day of classes, he had his medical exam 1 day after classes. whatever you beed to do for an interview in Manilla has to be done ahead of time, medical exam, police certificate, translations, etc. All must be ready. If it takes 3 months to arrange an interview, then you have to start on that 3 months in advance, at least. It is kind of like planning a trip to the moon...only more complicated. :lol: Fortunately Kiev is easy, just call and make an appointment and if you are far enough out in your plans, you can pick the day...we did. Then her son needs to get on an airplane and get here as soon as he has his visa.
