Indonesia - Siri wedding and Islam conversion for K-1 Visa, help please

Hello everyone :)

I've known my fiancee in Indonesia for 8 years now. I've met her for the first time in Indonesia a couple of weeks ago and got engaged. I am back in Chicago and ready to begin the K-1 visa process. However, I've got a few questions if some of you could please, please help me out with.

1) My fiancee's family in Indonesia would like me to convert to Islam, then do a Siri religious wedding ceremony (without a written contract), before she arrives in the USA.

a) How will the conversion to Islam while gaining an Arabic name, affect my K-1 visa application DURING the process? On the I-129F form, #7, it asks for "Other names used." Should I convert before, during, or after the K-1 process?

b) Will the Siri wedding ceremony without any contract being signed, be a problem?

2) Should I consider the K-2 visa process instead?

3) Does the photos of her and I together require EACH of our own signatures?

Oh I'm sorry. Is the K-3 a spouse visa then?

K-3 are no longer processed at NVC.

You would want to look at filing a CR-1 if you are thinking of legally marrying.

Hi Ryan, although I'm not a muslim but I live in Jakarta my whole life, so I'll give my best to help you out with your problems.

Here's what i know. Siri wedding is just religious muslim wedding, it is not official according to our government. No contract will be signed. Obtaining arabic name after converting to islam will not be official until you legally change your name to your arabic name. So i think it wont be a problem to have siri wedding during or before K1 visa process, as long as you dont make it legal. Dont mention about siri wedding during your fiance's interview at the embassy and dont provide any photo that would make them suggest you are legally married in indonesia. Just remember that siri wedding is not acknowledge by our government.

I really do not want to hide anything from anybody that may ruin or default the K-1 visa process. I just need to find out for sure if the US immigration/consulate/embassy will regard/acknowledge a Siri wedding as not an official or legal marriage. Thank you for your feed back TimJay :)

If she talks about " her wedding " and shows pictures of " her wedding " they could very well deny the K-1 saying she is already married if they believe her to be married ( even tho she is not legally married. )

Bring proof that you are not legally married to the interview.

It has happened to some people on VJ before.

It is better for you to consult the Siri Wedding issue while K1 will be file with an expert so you will get legal advice and won't get confuse. After i read here and there, seems filing CR1/Spousal visa is better since less money and headache in future once she gets in US. Good luck with the journey.

It is better for you to consult the Siri Wedding issue while K1 will be file with an expert so you will get legal advice and won't get confuse. After i read here and there, seems filing CR1/Spousal visa is better since less money and headache in future once she gets in US (compare the price between K1, AOS, etc and CR1 for yourself) and the time before she leaves for US. Just according to our experience, now we confuse about having the party before we leave. If we have it, we not feel secure and scare that it will cause problem to K1 petition, while in another hand we wanna show and proof to fiancee's family that we really care about fiancee by giving her a big party in front of her family, friends, and neighbours. Although big party is not the only way to show that we love and care about our future wife. Good luck with the journey.
