Hi Kala...for my wife's case, we sent a certified copy of her original birth certificate, and the original birth certificate was invery bad shape heheehehe...but they accepted the certfied copy of it with its corresponding translation from Portuguese to English.... are you going to apply for a CR-1?

In our case, we had to get a new birth certificate for my husband (brasilian) to prove that he was not married already. We only needed this when we went to register our marriage at the brasilian consulate. We used the K1 visa, so if you are doing a spousal visa, you would need the new birth certificate. What stage are you at? AOS or visa?

We are doing a spouse visa dcf,but we havent filed yet. so sounds like we need a new one. But how about the petitioner, do I need a new one too?

If you are the US citizen, you shouldn't need a new birth certificate.

The Brazilian consulate didn't require that we have a recent copy for his K1. We used one from 2008, and it was sufficient. We used it for his AOS as well. We did, however, have to have his father pick up a new 2nd recently, so we can register our wedding with the Brazilian consulate.

kala, your husband does not need a recent birth certificate for the visa. You do not need YOUR birth certificate, as a photocopy of your passport (all pages) will suffice.
