Timeline

Hi. My husband is broke at the moment and cannot afford the 1010 for the aos filing fee. His lawyer mis-represented the timeline information which leads us to this situation.

Anyway what are our options, and i mean all options. I think we can apply for an extension but i want to know the other options. BTW the 90 days ends in 2 days. Also if I happen to stay over the 90 days what exactly will happen?

I'd pull out all the stops to get work, trade labor for the cash from family or friends, sell stuff, get rid of things I was making payments on that I could not afford. Shop at the thrift store, don't eat out, etc...A person can live on very little if they are frugal and can spend the money on what is really important (like this)

You can stay here "out of status" - it isn't an "illegal alien" problem. If you get stopped at one of these inside-the-border checkpoints or for whatever reason have to show your status to authorities it goes so much better if you have applied for AOS.

Sounds like you need to get rid of the lawyer if you got bad advice. I would get back some of the retainer if you paid in advance and are giving him the boot. You sound like you need a co-sponsor, but I'd be doing my best to make it on my own.
