This is great help. Thank you so much. We are now waiting for a response after submitting all required docs. No lawyer advice so far... Fingers crossed. One more question... We can just wait until a few days before the appointment at consulate to go with stepdaughter overseas for interview, right?

Remember she has to go through the medical exam, so you will need some time in the country.

Ok... The time has come.

My step daughter (8 yrs old) has her interview for CR2 consular processing next Thursday (1/12/12)... Can anybody give me some possible questions during this interview? Since I made the petition for her I will be the only going with her. Her mother will be near, but will not go to the interview due to some things that need to be taken care of during our quick visit to the country. Will this be a problem? I think we have ALL the documents they would ask for. Do we need to bring pictures? What questions would the consul ask her or ask me? Help... :-)

It's not likely they're going to ask her much of anything. Unlike a fiancee or spousal visa, a CR2 does not require any sort of relationship between the beneficiary and petitioner other than the one legally established by marriage with the beneficiary's biological parent. In other words, they can't deny the visa for discretionary reasons such as not believing she knows anything about you or thinks of you as her father.

Her previous time in the US as an EWI should be irrelevant in her visa case because aliens do not begin to accumulate unlawful presence until they are 18 years old. She shouldn't need a waiver in order to get a visa.

It's possible they may ask why her mother didn't attend the interview.

Help... We went to our interview last Thursday and the consul did not proceed with the interview because my stepdaughter´s mother (my wife) was not present at the interview. Now, we have to go back tomorrow to get interviewed. They never mentioned in the letter we received for interview that she needed to be there. I (the petioner) was the one supposed to be there with my stepdaughter, but yet now we all have to go. Is there a reason why the consul might have asked for the mother? Should we be prepared for a stoke interview or something like that? My wife has her green card already through AOS.

After going back with my wife for final interview to get visa for my stepdaughter, my wife and I were interviewed in separate rooms (stoke interview) and they never asked my stepdaughter even a question. I can't believe how this happened, but it was horrible waiting in the small and uncomfortable benches at the embassy for about 9 hours before getting interviewed. We were asked for documents that had nothing to do with a DS-230 consular processing or even listed in the letter we received with the interview date and time. Thank God we came prepared. We were asked for a bank account letter under both of our names and more family pictures. I don't get this!!! My wife obtained her green card about 2 years ago and we already went through a similar process in US. After the stoke interview, we waited for about 30 more minutes and got called again. The consul just handed out my stepdaughter's passport and said "your visa has been approved" and nothing else.

All kind of questions were asked: when/where did we meet?, where do we live?, where does she/I work?, vehicles... who drives what?, what time she wakes up?, what time she has to be at work?, when did we get married?, why don't we have any kids of our own?, what is she on for birth control?, what time does she get home? Any bank shared bank accounts?, How much do we pay for rent?, who lives with us?, how did my wife enter USA before we got married?... and maybe a few more questions.

Thank God everything is done and over with.

One more question... I am a US citizen and my stepdaughter is 8. Does she automatically qualify to become a US citizen? Can I just apply for her passport at the post office?

Do I have to apply for naturalization for a 9 years old coming to US after consular processing through me being a citizen?
