Hello Folks.

Neither my fiance or I were not told by the USCIS that we had been approved but I eventually received packet 3 & therefore realised that this must be the case. So, the question is do I need to have the actual NOA2 for any reason? Perhaps at the interview? I don't see why they would want it but I just want to make sure.

I called the USCIS & asked them if we had indeed been approved & they just repeated the same info that was on the website about our case, which was nothing different. & I emailed CSC & they emailed back saying that they do not reply to emails (which is weird coz they replied to my last one) & to contact them via the USCIS customer service line.

02-04-2006 sent the last bit of information to attorney for I129f

02-11-2006 attorney sent I129f to TSC (package was then forwarded to CSC at some point)

02-16-2006 receipt date according to I797

02-21-2006 receipt date according to USCIS website

02-22-2006 notice date

05-31-2006 travelled to the US for 90 days

05-31-2006 touched

06-20-2006 called USCIS to update Charlie's (petitioner) address

08-09-2006 recieved packet 3. Do not know when we were approved as we were not told.

10-13-2006 sent packet 3 to embassy. Requested interview for February (at the earliest) as I need to finish

uni before I leave the UK

02-12-2007 interview date. But have to change the interview date again due to unforseen circumstances not

allowing me to travel to the States until September 2007. Boo hoo

04-10-2007 interview date! Yippee!!

04-17-2007 Passport arrived with visa! Sooooooo happy!!!!!!!!

Did either of you request a packet 3 to be sent in advance? Do they have your NVC case number listed anywhere on your cover letter?

I would assume you were approved, but I might phone the Embassy if I were you, just in case.

You will need a copy of the NOA2 when you apply for AOS. I had the same problem when I was approved and it took 4 months to get a copy of the NOA2. The USCIS website kept saying case is pending but I received a letter from the NVC stating they received an approved case. I wasn't able to get a copy of the NOA2 until my file was back in the US, which of course was after the visa was issued and Eliana was here in the US. From other discussions I have seen here, I guess it might possible to use other evidence when you file the I-485 (having a visa is good evidence you were approved) but I would try to get a copy. After many phone calls, one of the operators told me that cases get approved but sometimes they don't update the computers. Good luck on the rest of your journey

Try and call NVC. Speak to an operator and give them your NOA1 number and if they've sent the petition to the consulate, they'll be able to inform you about that. In case USCIS has failed to mail NOA2, you can request one: http://www.uscis.gov/graphics/howdoi/dupapp.htm

I only offer advice - not even legal. Just the plain and simple kind.
