please help we dont know what to do, I am the Beneficiary (Filipina). the issue is my fiancee (USC) has a different last name. Passport and BC has the same last name but it is different in the Driver's liscence and bank account. what we should do...? we cannot decide if we are going to send the application because we do not know what to do...? please we do need all your help

Hi, you do not state why there is a difference in last names...is there any sort of documentation as to that reason? Maybe proof of a name change from some gov. agency or church? Just asking.

If you can show the USCIS the reason, they will accept that, I have done that in the past for another person I helped. Ray

Is the last name on the passport and BC the correct last name? If it is, then go ahead with the application since it's the passport and BC that your fiancee will need to file the petition. However, he should also immediately have the last name on his driver's license and bank account corrected especially if he needs to use his bank account statements later during the immigration process.

If the last name on the passport and BC is NOT the correct last name, he can still go ahead with the petition. However, he'll have to include legal documents that made the name change (http://www.uscis.gov...i-129finstr.pdf - see page 3, item 6C).
