My fiance is a Chinese citizen who attended school in the U.S. as a foreign exchange student. After he period as a student ended she went home, to China, and since then we started the k-1 visa process. I compiled all of the necessary documents, and found out she is subject to the two year home stay rule. According to the Chinese Education dept. in D.C. she can no longer apply for a waiver since she is in China, and not the U.S.

You cannot mean to tell me that she is the first person in the history of a k-1 visa to have gone home, and needed to get a j-1 waiver. I am looking for some advice, and any advice on what we can do.

Is there another way we can go about getting it waived? Is there another visa I can bring her here on, and get the waiver during that period? There has to be something we can do about this.

What really stinks about it is that I actually just packaged the k-1 petition, and was going to mail it today. It was a swift kick to the groin, and I am in need of help so please anything will do.
