But that is after the fact, and if you lie, they may be able to strip you of it if you of it after the fact.

How can they take your citizenship away before you have even got it. It's like saying someone stole my new car which I was going to buy from the dealer next month. I don't know how anyone can lose something they haven't got and never had. You do not become a citizen until you take the oath, up until that point you are a PR. The may be able to strip, there is no may be able about it they can do so. The only time they can take your citizenship away is after you have become one. Up until then they just do not let you even become one.

Instead of posting sarcastic comments about your posts being invisible it might be a reasonable idea to think about what you say.

OK, I am not trying to be sarcastic, I am just completely flabbergasted that people keep referring to my FIRST post and have completely overlooked my SECOND post which explains what I was THINKING. AFTER THE FACT is not BEFORE you even have it, it is AFTER THE FACT. meaning AFTER YOU HAVE GAINED YOUR CITIZENSHIP. they can possibly lose their citizenship AFTER THE FACT if they are caught lying on an application for citizenship. In other words, AFTER THE FACT of becoming a citizen they may be able to strip him of his citizenship for having lied. AFTER THE FACT are the key words.

perhaps I was sarcastic because I am becoming frustrated that no one seems to be paying attention to the words AFTER THE FACT. Sorry if you were offended, I guess I am just shocked that no one knows what "after the fact" means.

No, I did not commit perjury because this crime happened AFTER I passed the interview. Once they ask me if I've committed any crimes before the Oath Ceremony, I will tell the truth, in which case, I'll probably have my application denied. I have another concern. Is there a chance that I will be deported over this petty theft issue?

anyone?

I don't know, no one ever posted anything like this before. Post that bit on hiring an attorney to keep your record clean while making restitution and paying a fine, did you contact an attorney? Suppose a lot depends on what you swiped, did mention saw a kid, around 12-14 years of age arrested and handcuffed for swiping a candy bar, they take shoplifting very seriously.

Did go to our local police station once when they were trying to sell unclaimed stolen goods, was all junk, who in the hell wanted to steal that #######. Can find better stuff in a trashcan. What did you swipe?

I know I'll probably get my application denied, but I just wanted to make sure.

I'm going to be completely honest here. I'm in the process of obtaining my citizenship. I passed the interview and was recommended for citizenship approval on Sep. 17, 2010. I was arrested for petty theft on Sep. 29, 2010. This is my first offense. There's no need to remind me how unbelievably stupid and morally reprehensible this decision is. I'm not looking for justification. I know what I did was wrong, and I'm ready to accept all consequences.

Let's get more of the facts straight. You posted that you were arrested. Given that it's only been less than 2 weeks, you couldn't have been convicted. Most likely, the DA hasn't even officially charged you yet. There is no chance of any deportation until at least a conviction. Can you be deported if you're convicted? Yes. It's certainly possible. Will you be deported? The chances are good you won't be deported. Given that it's not a violent crime, you're not on their priority list to deport.

If you want to stay in the US and become a citizen, this is NOT the time to be cheap. Find a good (expensive) lawyer and really fight this charge. The best way out of this is to NOT be convicted on this charge.
