Hello,

I had a general immigrant visa question that I hope you can shed some light on:

I am trying to apply for an immigrant visa for my brother (unmarried, under 21). I am a US citizen & my parents have US Green Cards. My mother is the petitoner. In filling out the I-864 form, am I the sponsor? I don't have sufficient income so I will be using my husbands financial info. I understand that he will need to fill out I-864A but who actually fills out i-864, particularly Part 1 & which option applies (A-F)? I appreciate any assistance you can give me on this matter. Thanks.

Petitioner completes an I-864 as the primary sponsor. If their income is not sufficient then a joint sponsor completes an I-864 as well. If the joint sponsor is a household member of the petitioner then they would complete an I-864A rather than an I-864.

Petitioner completes an I-864 as the primary sponsor. If their income is not sufficient then a joint sponsor completes an I-864 as well. If the joint sponsor is a household member of the petitioner then they would complete an I-864A rather than an I-864.

Thanks for the reply. So that I understand this:

My mother (petitoner)fills out the I-864 form as the sponsor & my husband would complete the I-864A?

Son in law does not qualify as household member. So he would use the I-864 and would need to qualify on his income.

So there would be 2 I-864's submitted. One from the petitioner (my mother) & one from my husband..? And then he would select option D (I am the only joint sponsor) in Part 1? Thanks.

On the I-864 for my mother, as she does not work, the income will be 0.

1. Does my husband get listed anywhere on this form? Particularly part 6, question 24 b?

2. What option needs to be selected in 24 d or e? Neither seems to apply.

On the I-864 my husband fills out:

1. Does he list anything for 24 b?

2. What option needs to be selected in 24 d or e? Neither seems to apply.

If no one in Mom's household is combining income through form I-864A then 24 (b, d, &, e) are blank(s).

Same for your husband if he is not combining income with a household member.
