Hello everyone,

I have a question concerning Form 1-130. First page question 16.( Has your relative ever been under immigration proceedings?) The answer is yes,but I don't understnd where. I was process in Montreal, is that what I put and the date of the interview? It was approved, do I check-mark the approved section? Also second page section D other information question 2. The answer is yes, place? and the date of filing and results? What is excactly the date of filing mean?

I was process in Montreal, is that what I put and the date of the interview? Q#16 is such as removal, deportation etc. of the beneficiary. If that's not the case, put NO (very important)

It was approved, do I check-mark the approved section? Also second page section D other information question 2. The answer is yes, place? and the date of filing and results? What is excactly the date of filing mean? Date of filing means when the first I-130 was sent to the Service Center.

Yes , we are. I had to return to Canada after only being in the USA for 4 months due to family illness. Can you help with the question.

We are also in the same boat. My wife went back to India after getting her first green card. Now I am filing her second green card.

I think you also had previous GC.

Questions:

1) When was it issued and expiry? Is it CR1?

2) Did you take re-entry permit?

Explain in detail, then I can give you better answer.

We are also in the same boat. My wife went back to India after getting her first green card. Now I am filing her second green card.

I think you also had previous GC.

Questions:

1) When was it issued and expiry? Is it CR1?

2) Did you take re-entry permit?

Explain in detail, then I can give you better answer.

It was a CR1, my interview was in Montreal sometimes in April 2009. I entered the USA on July 19,2009, I left and abandont on Nov 16, 2009. No, I didn't take a re-entry because in Canada you cannot have two adress to use the medicare card. I was explain that at the border when I cross over back in Nov, 2009. My husband and I file our first 1-130 back in June 28, 2007. We married in the USA on June 16,2007. We had no problem being approved.

I do have the old passport with the old visa in it. It is expired for sure. I cannot remember my alien resgistration number which was given in the mail sometimes in August of 2009. Is that enought?

You are in perfect position like us! You also abandoned the GC same like my wife.

Now your petitioner has to file entirely new I-130 form. Never put YES to Q#16. You should put NO.

Section D: Q#2: YES. Name of the beneficiary, place is which service center. Filing is previous I-130 filing date. Result: Approved.

You need to somehow retrieve your previous A# which may need to be filled in G-325A.

Where did you abandon it? At border or in the Montreal Consulate? Did you file I-407 as part of the surrender? Did you get a copy of it?

I turn the card in because the guard told me I had to, because I was going in Canada to seek medical help. You cannot have two addresses to use the medicare card, it is called fraud. We are hurrying before the year is up. It will be one year on November 13,2010 since I left the USA.

If you don't mind me asking, what happened that you and your wife is going through the same thing. I truly understand how hard it is, we are in the same boat. I hope we can help each other.

The number on your passport is NOT A#. You will have to check your welcome letter etc. to spot this A#.

My wife was also in CR1 in 2008. She was with me in the U.S for over a year. She wanted to do some higher studies and left to India. We didn't take the re-entry permit as well. She abandoned her GC at the Consulate in India. Now she is ready to come back. So, we are filing an entirely new petition. I know it is a painful process to re-start again.
