citizenship for child less than 18 yrs

hi VJ's,

I came on CR1 and my daughter accompanied me on CR2. now both of us got our 10 year GC. My daughter is 12 years old now. I understand that i can apply for Citizenship next year this time. After reading the guidelines I really have a doubt,I am applying for citizenship based on my mariage to a US citizen,so whether my child who will be only 13 next year (who is the step child to my husband) can apply along with me for citizenship.I read that children less than 18 years are not eligible to apply for Citizenship.It also states that only adopted children who are less than 18 years are eligible and step children are not. since my daughter is only 13 next year won't she be able to apply for citizenship?

please help me.

Yes - upon you naturalizing your daughter will naturalize as well. In other words, you make her decisions for her when it comes to USCIS until she is 18.

N-400 Naturalization Timeline

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

Timeline

My sister-in-law just went thru this with her daughter. As I understand it, she filed N400 for herself. After the oath ceremony, I believe, she filed N600 for her daughter.

Yes, your offspring becomes the child of a US citizen at your oath ceremony. Just make darn sure you apply before she turns 18. I like to blame the USCIS for the long delay in our AOS where my stepdaughter turned 18 before my wife could apply for citizenship. But also our fault as well, instead of getting married right away when we thought we were sure, we dated for two years first before tying the knot to be darn sure. That extra 18 months gave her daughter time to turn 18 plus the delay of the USCIS in the AOS processing.
