I've read several threads here about this, and I am beyond confused. There is a ton of conflicting information and none of it seems to make any sense.

My wife and I got married last week, and we already have her SSN card under her maiden name.

She wants to change her family name to mine, and we are in the process of getting paperwork started for AOS.

How should I proceed?

Should I file AOS under her maiden name? Or should I take the certified marriage certificate to SSN office and get her name updated, and file AOS under her new name?

What is the proper procedure?

Filing for AOS in her married name is a somewhat independent process to changing her name with the SSA.

You can try to get the name changed with the SSA with the marriage certificate - I would suggest going before the I-94 expires. If they deny you, just wait until the EAD arrives in her married name and get it changed then.

File for AOS and the other documents with the name she will be using going forward (married name). You can do this regardless of her name with the SSA. They see the names change all the time with these family based things. It's not surprising and not a place where people get tripped up.

File AOS using MARRIED name if she wishes green card to have married name on it. Form I-485 has a line stating "Name on I-94" there you will put maiden name, G-325A has line that says "Other Names Used" This is for maiden name.

Once you have green-card and/or EAD card with married name you can visit SSA and request a SSN card with married name, better to do this after getting green-card, the resulting SSN card will have the "With DHS Auth" restriction removed.

Note: applying for AOS in maiden name and then later trying to change the name on the green card will COST YOU $$$, I-90 is filed and the FEE is $300+
