Hello

i have a question.. regarding the AP form !

Me and my husband are in the middle of filling our AOS paper work.. and the AP form , i know its optional.. But what is excactly .. ?

is it for people who are planning on leaving the USA for a bit or is it a permition in case u need a permition to leave the usa ?

If we decide not to do this form(because im not planning on leaving the usa for a bit)

and later on the road we change our mind or i need to go home for a emergency something like that.. can i still apply for the form ?(without the fee)

Any advice would be Nice and helpful

If you are filing for adjustment of status, you normally cannot leave the US without permission. (If you do, it will be presumed you have abandoned the AOS process, so it is closed.)

Most people get it while doing the AOS process, since, there is no charge for it (and you can apply for it after you sent in the initial AOS, still free) - just in case they need to travel prior to getting the greencard.

Be warned though, you have to make sure you are eligible for the AP, if you have any overstay over 180+ days, even with an approved AP, you could be subject to a ban upon your re-entry in the US.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So i dont have to send the AP form at the same time as my EAO AND AOS ??

( if 1-2 months from now i need to go back home for something i can still apply for the form for free? if i havent received my green card?)

My suggestion would be to go ahead and file for everything at the same time; the Adjustment of Status (AOS), the Employment Authorization Document (EAD), and the Advance Parole (AP). You can file for all three documents for the same AOS fee and you can have the peace of mind of having the AP if you need it. Even though you are not planning on leaving the US any time soon after entering on your K1 visa, there can always be an unforeseen event or family emergency for which you would need an AP to leave and be able to re-enter the US on short notice. If this were to happen, you may not have the time to wait to get an AP approved.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Alright sounds good but what i dont understand is… the part where they ask you the date of leaving and how long youll be out of the country etc …

what do i write ? im i allound to write "Unknow" or "just in case" ?

im a bit confused on that one !
