Hi there,

I have run into a problem here and I thought I would get some useful advice/guidance on this great forum. My mom holds a valid permanent resident card. She went to Pakistan in Feb 2008 due to some urgent matter and didn't get the chance to obtain a rentry permit. She ended up staying there in excess of two years due health reasons. I found out that since she didn't obtain re-entry permit, she can re-enter USA either through a return visa or I would need to re-apply for her I-130 petition to get her an immigrant visa to start fresh.

I decided to file I-130 for her to get her immigrant visa. The petition was approved and sent to National Visa Center for further processing. Now just yesterday I received a letter from NVC saying that the "NVC has received informtion that the beneficiary is now a permanent resident or citizen of USA. This petition has been returned to the US Citizenship and Immigration Service."

Now, I do not know what to do. Please advise me what should be the appropriate step to persue next. I thought NVC would approve the application and send it to US embassy abroad. Your useful advice and feedback would be greatly appreciated. Thank you.

You'll need to actually call into NVC on Monday, and talk with a supervisor, explain about the '2 years out of country' problem.

Apparently, this 'problem' was not covered in any 'cover letter' that you submitted with the I-130, or the cover letter got tossed at USCIS, NVC not 'see it'.

Don't bother talking with the first human you get - get a supervisor, instead.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
