Hello,

I am wondering if I need to submit the AOS form before the K-1 visa expires.

I want to send in but now i am short of money. I just cant afford the money right now. I have all the forms filled out just need to get some extra cash. I dont want to wait cause I will get Marissa Ead and she is begging to find a job. I think she will send some money over to her family also but I dont want her to do that always.

so will she be out of staus if I dont submit the forms by the time her visa expires? We did fulfil the requirment of getting married within the 90 days. :)

Yes, she will be out of status, but you are allowed to accrue 180 days of out of status time... which will be forgiven when she gets her AOS approved. You can wait, (I waited for quite some time for the same reason), but of course, get it in as soon as you can (she will get her EAD and green card quicker that way..) Good luck!
