guys, i got married in the Philippines to an american. now we are filing for divorce. i am now a US citizen too...my question, will my divorce here in the states is automatically annulled my marriage in the Philippines? I will be the one to file. please help me thanks.

hello ikyang,

you need to register your divorce papers to your local civil registrar where you had your marriage registered and they will forwarded it to NSO it took 6 months more or less. if you marriage in church you also need to cancel you record at the church. sobrang daming gagawin.

If you are the petitioner (you file) then you will have to go through the legal annulment process in the Philippines.

If your husband files then there is a process to have the Philippines recognize your US Divorce as an annulment.

I do understand that if the petitioner is the foreign spouse not the filipino, it will be honored as an annullment too in the philippines...but my follow up question is, I am now a US citizen too..Can i file and don't have to do undergo the annullment process in the philippines?

Just one question... What is your citizenship when you got married. If you are a filipino citizen when you got married, then the Philippines law still apply to you. If you are the US citizen when you got married, then you could apply for divorce.

You better talk with a Filipino lawyer to know the right path.

Please share to us your experience.

We would like to know if a Filipino citizen on the time of marriage would have a special treatment when filing for divorce as a US citizen.

I was a Filipino citizen when i got married....now i am a US citizen...

I just want to avoid two filings...annulment in PI and divorce in US... as much as possible i want it to be one time filing..to save time and of course money.

I don't see how being a Philippine citizen in the past makes any difference. The state you are in governs the divorce laws, and you are a U.S. citizen so just simply follow your state law like every other U.S. Citizen in your state. They aren't going to say hey wait a minute, you were a Philippine Citizen in the past so we're going to treat you differently and make you go get divorced in the Philippines first.

I'm not sure why you would want to have anything additional at all done in the Philippines. Marriage and divorce of U.S. citizens (you) is recognized by the Philippines and numerous other countries by treaty. So you would not need to go to Mexico or Canada or Great Britain or wherever and file for divorce in any of those countries either.
