Ok on July 23 we receive a NOA that says after review we have reopened the above application or petion ro reconsidered the decision previously issued. You will reeive a notice under seperate cover oncel all action has been completed.

FYI my daughters 485 was denied due to a missing Schedule C.

Now we get a letter dated July 27 saying that the motion we filed was not signed by the applicant but by the USC and does not meet the requirements of a motion to reopen or reconsider. It is hereby ordered that the motion to reopen be dismissed as improperly filed. the decision to deny the Form I-485 is affirmed.

However, as the evidence submitted with your motion overcomes the grounds of the Services denial of Ms--- application the service moves to reopen her adjustment of status proceedings on a Service Motion.

I called USCIS and guess what they have no idea what it means as it is confusing and will send a request to the service office to clarify the situation and they will notify us by mail in approx 30 days...

This is unbelievable that they can send you a letter that even they don't know what it means...Oh and get this while I am on hold they are playing music in Spanish...WTH???

Did you make copies of what was submitted?

Dinging her on a signature sounds pretty easy to overcome and resubmit, though.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I did resubmit everything yesterday morning..paid $16 to overnight it...I have now found out about this letter I got today..basically what they meant was that since the 485 was denied for a missing Schedule C there was no need to file the I-290B (even tho the orginal denial said to do it)..all I had to do was sent the missing schedule C with a letter and the Service office can take it upon themselves to reopen a decision..basically I could have saved myself $585...but since they rejected my 290B due to the wrong signature they have dismissed it ..kept my money but have decided to reopen the decision of the denied 485 on their own...

Nice huh?? I hope someone enjoys my $585 that I apparently don't need as much as they do..
