Hi everyone...

So, heres my situation. I was living in the US for 7 yrs, my family and I came to the US late 2002 and we were there applying for asylum. Anyway, we were denied all the time and we supposed to leave the US the end of Jan 2010. My lawyer at the time screwed us up by not filing any extension to stay because we were planning to leave the end of August 2010.

With that being said, Last october I met my boyfriend and we started our relationship Jan 2010. BUT i was detained on March 2010 and given the 10 yr ban. My boyfriend really wanted me back and i wanna be with him soo bad too.

We wanted to apply for K1 visa, but i realized that we only have 1 pic together. I started to save our chat conversation and gift receipts that we have sent each other.

We dont have any visa stamp or ticket or anything.

He was going to come see me next month, but unfortunately something came up that he has to work so he wont be able to come. we want to start as soon as possible, but what should we do? Are those evidence would be enough? I have some pics of me and his kids!

And is it possible for me to obtain K1 visa with the ban that i have?

Is it true that if we are applying for K1 and get it approved, I would have an interview and I will be denied, but I have to turn in i-601 (the extreme hardship) and i-212???

I'm not sure about the amount of evidence. It might be enough. Usually they want to see that you have met within the last 2 years and most people send boarding passes showing the USC has visited the fiance's country. But in your case you were herein the US.., so maybe show evidence that your mailing address in the US at the time was near where your boyfriend lives.. in addition to evidence you listed already.

Yes, you will be denied at the interview and then have to file the waivers.

I'm pretty certain, and if I'm wrong I'm sure someone will come along and correct me, but since you received a 10 year ban, your fiance will have to prove extreme hardship on himself, and honestly I don't know if this can be done with a k1 petition, you may have to marry in your country and apply for a CR-1, and again he would have to prove extreme hardship on himself (because of your absense)and stating why you should be allowed back in. In my opinion your case is more complex and you should probably consult an immigration attorney and work with them.

You will be fighting an uphill battle in your case. The hardship case has to be made by your fiance for himself and not for you. You might be able to do it, but I would suggest that you work on an alternative plan and have your fiance start learning Indonesian and look into what jobs might be available in his field within Indonesia.

Well he has 2 kids and theres no way he is leaving his kids there or separate them with their mom
