Signed letter from parents. In some places you might need a judges permission to marry under age. Marriage licence is for when you are actually ready to get married.

shes in texas so all it would need is a signed letter. do we need to have any wittnesses or anything or just a simple written and signed letter? many thanks for the help

A simple signed letter should work. You can get it notarized if want, but I don't think that will make a difference.

You might want to include a second copy of her birth certificate attached to the letter which shows the name of the person granting the consent (highlighting the name wouldn't be out of the question). The person writing the letter should have it notarized as well. They can do that at any bank or tax office for a nominal fee (many places even free). Be sure to have the person include their relationship as mother/father/legal guardian.

Good luck!

I'm not at all familiar with the K-1 process, I just did my AOS. But I suppose that if the K-1 visa allows it with proof, it is certainly very possible. If I were you I'd have everything notarized, and probably have some affidavits, just in case.
