HI,

I am US citizen and I sent I-130 for my wife on february 14 2010. when i login to USCIS case status with my case #

it says:

Initial Review

On February 22, 2010, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

I am getting a bit worried since 5 months has passed by and there was no change made to my status nor was any other requests made or mailed to me.

I recently made a address change and it was changed promptly. I called them but told to wait.

Should I be worried? I checked the status of similar date filers and all of them seem to be approved at this time. Any suggestions will be greatly appreciated.

Thank You, Damian

I am no expert but I know that if the final desicion on your petition goes beyond the USCIS processing time, you should call the USCIS and inquire about your case. The last time I checked the processing time was 5 months, so add 5 months to your NOA1 Date and if it's past that period you should call.

Good luck and I hope it works out fine.

It also depends on Processing Center too. I've sent my I-130 to California Processing Center on March 5th. And it's approved on June 26th. Sometimes in June, I called USCIS. One of them had told me to wait at least 6 months. I didn't give up and called again. This time I talked with a nicer rep and explained my situation and he said that he'll try to help me out. A few days later, I received approved email from them. Maybe it's just pure coincident. But who knows what can they do. Good luck with your case.

Thank you all for your replies. I called today I and I spoke to the customer service . I was told the case is within the processing time and if I do not receive any decision on the case by the end of the month I should call back. Dunno what else to do at this point but wait another two weeks..
