Those with AOS approval pending FBI name check..

Timeline

We joined the list on August 8th...we are planning a trip back to Canada at the end of September, the officer advised me that we shouldn't leave the country while AOS is pending because he said I would be "out of status" upon return since I don't have my Green Card and in the system it is "pending".

I thought the whole point of getting AP was so that we could use it while AOS is pending. He told me to talk to an attorney before we leave the country. Though he did say, that since it was "Canada" it probably shouldn't be to difficult to cross back and forth. I asked our attorney and she doesn't seem to think it will be a problem.

Were any of you advised not to travel with AP while your FBI name check is pending?

we have traveled 2 times since our interview, you have an AP, you are allowed to use it with no restrictions. Just like your EAD still continues to be valid.

I wanted to add that I dont know how you adjusted, so if you overstayed a VWP, etc, I wouldnt be able to give you the best answer

Oh, I came over on a K1...no overstay...nothing...so I think I am in the clear?!

An approval pending checks is not an approval. Your AOS is not complete. The AP is still valid.

I am in the same situation. But during our interview, the officer told us about the name check still pending and added "well, you have AP and EAD, so you are free to work and travel in the meantime".

The inconsistent information they give people is amazing! :lol:
