Hello VJ, I’m in need of some more help. Today I received the hard copy of our RFE.

It states the following:

Multiple fiance(e) Petitions: International Marriage Broker Regulation Act (IMBRA) imposes limitations on the number of petitions a petitioner may file or have approved without seeking a waiver of the application of those limitations. It appears the petitioner, ME, has filed two or more K-1 Fiances (e) petitions at any time in the past or previously had a K-1 Fiance(e) petition approved within two years prior to the filing of this petition, the petitioner must apply for a waiver. To apply for a waiver, the petitioner must attach a signed and dated request for the waiver, explaining why a waiver would be appropriate in the petitioner’s case, together with any evidence in support of the request. Examples of such evidence include, but are not limited to: death certificate, police reports, news articles, or medical reports from a licensed medical professional, regarding the death of alien approved for a prior K visa.

We knew this was coming and I tried to send in the Waiver before they looked at my file, but didn’t get attached to my file, anyways, My question is the Waiver enough or do I need evidence, my ex-fiance was cheating on me and living with another man and lying to me to get here to the US. Her plan was to move here divorce me and have him come here. I found out and broke our engagement and communication off immediately. I had no contact with her since this happen, and moved on with my life deleting any information I had regarding the relationship. The visa was appoved anyways and I tried to cancel it before it left the US, but no luck I called the Embassy of the country the visa was being issued and finally canceled it there. I have a copy of the E-mail I sent to the Embassy and there response, but that's it.

They are just looking for some reassurance from you that you aren't acting as a one-man immigration portal. Explain the situation just as you explained it in your post. Provide whatever evidence you've got, including the two emails. Be sure to point out that you stopped the visa from being issued, and your previous fiancee never came to the US. Seriously, these waivers are not difficult to get. You just need a reasonable explanation and the waiver will be granted. Don't forget to sign the request letter.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
