Hello, Im new in this forum and I have a few questions...

What will hapen if a usc wants to file for K1 while her fiance is illegally in the United States.

Would they get caught? if so, how? He does not have anything under his name or anything like that. He is planning to go back to his home country once we get NOA2 so we can get ready for the interview.

What do you think, The immigration attorney said she already had 2 cases similar to this. one of them got the visa and the other one is waiting for the interview, he already received NOA2

Did the immigration attorney mention the waiver you'll need to file? You might find more people in your same situation here: http://www.immigrate2us.net/forum/viewforum.php?f=26

They can better explain what happens, including if it is safe to file while the foreign fiance is in the US.
