I-765: Concurrent with AOS or Not? E-File or Not?

My spouse will soon enter the US on a K-3. What is the best way to apply for EAD?

1. Before applying for AOS -- Category (a)(9) (mail to Chicago Lockbox)

2. Concurrent with AOS -- Category ©(9) (mail to...?)

3. After AOS Application sent and Receipt received -- Category ©(9) (E-File)

Does one process take a longer or shorter amount of time than the other (because of the different Categories)? Is E-Filing (Option 3) any faster than the other options?

The fastest way would be to file for the EAD along with the AOS. The EAD would be under the category of AOS. The EAD would be processed faster than the AOS. The EAD will be failed about 3-6 months whether you file with AOS paper format or E-file. Hope this helps :thumbs:

You can apply for both at the same time. If you wait until after you apply for AOS it might take longer.

07-09-08 I-751 Sent to VSC

09-16-08 Biometrics Appointment (Completed)

02-25-09 Transferred to CSC

03-20-09 Approved (without interview)

03-27-09 Emily is born!!!

04-07-09 Green Card Received!!

11-18-11 Lucas is born!!!

N-400 Journey*

12-15-11 N-400 Sent to Texas

02-09-12 Biometrics Appointmnet (Completed)

03-21-12 Interview (Approved)

03-21-12 Oath Ceremony

PROCESS IS DONE!!!!!!

I filed my Wife's EAD with her AOS application, I am learning that EAD takes Aprox. 90 days from filing date to be approved, And lately for most cases that are not complicated Interviews are happening within 90-120 days, so my point is if you have your interview for AOS and get approval for GC You won't need EAD.

That being said, We filed EAD as insurance so we could use the EAD to get SSN & Drivers liscense fo rmy Wife, in case the AOS process took too long she could at least have DL, and even work if she needed.

File EAD with AOS but don't be surprised if you do not receive EAD before your AOS interview .

You may be spending the $$ on EAD it will have been wasted if GC approval comes prior to EAD, even if EAD comes on day 90 and AOS interview ( as in our case) on day 96 IF approved for GC we will have wasted that money on EAD.

Also if you are lucky enough to get your EAD before AOS inteview upon approval they will take your EAD,

since you wont need it .

StillWe do not regret filing it as one never knows what can happen with USCIS, EAD will allow you to get personal business taken care of help establisbh your new life here while waiting for AOS & GC
