Hello:

I've been searching VJ and found topics close to my question, but not exactly. Hope somebody can advise!!

I'm in the process of applying for K1 for my fiance in Cambodia, and K2 her beautiful 3 year old daughter. She has ben divorced for 3 years. Her ex-husband left right after the baby was born and she hasn't seen him since and does not know where he is at. He has realistically abandoned them and her daughter has never seen him, nor knows he even exists, and he has never suported them at all. (She lives with her biological family)

My fiance obtained a birth certificate for her and her ex is not listed and she has given her daughter her maiden surname.

Question: Will I need some sort of authorization from her ex-husband in such a circumstance to let her daughter come to the US? Again she does not even know wher he is at.

Generally...NO. Since the father is not listed, from whom would you get permission? Some countries, notably Ukraine, in such cases require a "certificate of no father" which can be easily obtained if no father is listed or if the mother attests that the name given was a "made up" name, this is because of the Russian/Ukrainian tradition of the Patrynomic, giving the child the first name of the father with a suffix.

Alla was a "child with no father" and her Patrynomic is that of her maternal grandfather. She still keeps her document though she is long past the age to need it for anything.

Check with the consulate to be sure (by email) but I doubt you will need anything

Thanks much Gary and Alla for the reply and advice!! I too think this will be the case but am doing as much research as I can to try to avoid and "hiccups" in the process. We are getting all documents translated now to English and I'm in the prcoss of contacting the consulate to verify!!
