Visiting USA while CR-1 is pending

I've never had a problem and I've visited a few times after we were married. I always bring strong ties ie letter from my employer detailing when I'm scheduled to return to work, I bring copies of the NOAs, mortgage title documents, utility bills, current insurance on the house etc. Never been asked to see any of these documents but I had them. I have another trip planned at the end of June and a few weeks before my interview in July. I can't imagine that I'll have a problem.

The 'written proof' actually says the opposite - that because you are married to a US citizen you are considered inadmissable to the US because you are viewed as an 'intending immigrant'. As such, it's not illegal to visit - it's only illegal to marry and remain in the country while your immigration status is pending. How will they know you won't stay? You require proof you won't. So that means that it's up to the POE official to determine whether you will be admitted or not. And even if you are denied entry, it won't affect your visa petition, assuming it was a denial not related to criminal issues of course.

If you bring strong ties to Canada you'll be fine. Enjoy your trip.

Hey there! I was just wondering how come your husband dosen't just visit you wouldn't it be easier since he isn't trying to immigrate. I'm going to visit my husband in canada towards the end of this month. =)

I'm not sure there is much else you can do without any documented ties to Canada. :( Your interview letter might be viewed by the border agent as evidence you are returning but you should be prepared to be turned back without anything else to show.

Recently having visited my hubby in California and traveling through YVR airport in Vancouver the POE agent asked these questions.

!. Why are you traveling alone?

...visiting my family

2. Who and where, and when was your last visit to the US?

...my husband who is a US citizen, and told him I was last down in March. ( My hubby and I travel back and forth every couple of months and so far I have not been refused entry thankfully.

3. How do you support yourself ?

...explanation...

4. Have you filed your paperwork ?

... yes still waiting for interview.

5. Why is it taking so long? ( at this point the POE agent seemed more interested in the process )

... Montreal seems backlogged ....

6. Why Montreal and not Vancouver ?

.... marriage visas are processed in Montreal ..

7. How long will you be gone?

... 3 weeks

Okay enjoy your visit...

I have found that bringing my paperwork neatly organized gives me more confidence in case I am ever asked for it. They document your traveling and I am sure they are able to pull everything up when they run your passport through. Just realize they don't always know the process we go through just as phoning NVC gets us different answers when we call. Some POE have been more casual and some more formal.
