I-864: Self-employed income is not predictable -What to state?

We are about to apply for AOS, but there is one thing that concerns me regarding the I-864:

1. I have a Co-sponsor whose income is enough to support me.

2.My husband is Self-employed: In 2009 he made $ 20.000 (which is not a lot for NYC)

2008 " $ 600 ( which equals to ZERO!)

2007 " $ 2.000 (")

He explains this that his buisness would fluctiate; sometimes he has projects and sometimes he doesn't. He always had support from his mother

and family who helped him out in the previous years. We live with his mother now.

He recently got employed with the Census where he makes money on regular bases now.

My question/concern: Should we inlcude a letter (a self-employment letter) which states that his buisness was not doing good in the previous years

and it picked up in the last year? Should we also mention that he took the Job at Census, so he could have/make money on regular bases?

His expected annual income for the current year is not predictable. What should we state there?

He will also get an employment letter from Census.

Would that be enough?

I hope somebody has experience in this area!

The I-864 is not for predicting income, it is for reporting income.

A letter stating that business was bad in previous years provides no benefit and is irrelevant.

You have two options on the I-864 - one is to send the most recent years tax return, the other is to send three years. Either way you have to report the past three years. (Section 25 of the I-864)

In Section 22 he would check (a) and (b). He is self employed as an ...... for (a) and he is employed by the census bureau for (b).

You need to calculate the household size and income required. If his new employment with the Census Bureau and his self-employment income, along with the joint sponser income meet the calculated poverty guides you may be good to go. It will be up to the interviewing officer to determine in the end.
