Hi, wonder if somebody could give me some advice. I am a British Cit and currently live in the UK. I am however engaged to a US soldier who is currently deployed in Iraq. He is due home in August and I will be flying over to the US in September to stay with him for a month or so. As he is anticipating deployment to Afghanistan in Feb 2012 we would really ideally love to marry as soon as possible and at least try and enjoy some married life living together before this next deployment in 2012. The problem is that we have been told by so many different sources, so much conflicting information that we don't know where to begin. Can I marry him when I go and visit in September? Or will I have to apply for a visa? and if so, does it really take a year for the visa to be processed?

Any ideas/tips/advice?

Thanks for your help :)

You should not marry when you go visit him on a tourist visa or the equivalent, since that will constitute immigration fraud.

You could go either the K-1 or the CR-1 route. The K-1 is a fiance visa, where in your USC fiance petitions for you to be able to go to the US to get married in the States.Time-lines vary between 3 to 5 months i,e in a problem free situation.

The CR-1 is a spousal visa, wherein you both marry outside the States and then he goes back to petition for you to come over to the States.Again time-line vary between 4-5 months. It depends. It will not take a year I think but one never can say anything too safe about immigration.

Good Luck!

Thank you. We were also told that he could apply for an I-30 him being a soldier. Do you know what this is? o is this information even accurate?

Also I think ideally I would love to marry in London as everybody I know is from there. Will this make the process any longer? and will I still be able to visit while any visa is in the processing stages?

This is incorrect. You may go to the US on a tourist visa and marry, then return to the UK. That is not an issue. The only time immigration fraud may be suspected is if you travel to the US on a tourist visa, with intent on immigrating. That's the fraud.

Also, the Cr-1 is not for people who marry outside of the US. It is for people who are married, regardless of where the wedding takes place.

You need to read the guides here and figure out which visa is best. His depolyments may qualify you for a military expedite so certainly look into that as well.

Good luck

Does it matter that I will be entering on the Visa Waiver Programme and not a tourist visa?

Where do I get information about whether or not we will qualify for an expedite?

thank you very much :)

Nope, doesn't matter. Entering on the VWP and marrying is perfectly fine.

You could have your fiance call the military helpline - they should be able to give you information about expediting. 1-877-247-4645
