When filing the K-1 visa for my Thai fiancee' last year, I sent in our only translation of her birth certificate. I was told that all original documents would be returned to me after the visa was approved.

When we went for the interview we were told that the approved petition and all documents had to be sealed and delivered to the imigration officer at our port of entry. At that time we could get her birth certificate back.

When we arrived at JFK airport we asked for the birth certificate back and were told he could not give it back, but we didn't need to worry because the petition would be forwarded to uscis and would be on record when we adjusted my wife status.

I started to file for the adjustment of status and called USCIS and was just told that all foreign documents written in any language other than english need to be translated. The only place i know that can translate Thai documents that the U.S. Government will accept is in Bangkok, 10,000 miles away.

Has this happened to anyone else? Any help would be greatly appriciated.

First of all, dont know who told you that you would get back your originals. But it specifically states in the I-129F instructions not to submit originals as you may not get them back.

For future reference and for anyone else dealing with originals. Always and I mean always have at least one other original document to keep for your records when turning in one set to any government agency!!!! Every document that we have, that requires original signature or is a "original document" is done at least twice. That way no matter what we have another set available if needed later.

I would recommend going to the regional forums for your area and or country and ask the same question. I can not believe that there isnt a service in the US that can do your translations for you.

From USCIS site:

"11.3 Foreign Language Documents and Translations.

(a) Document Translations. All documents submitted in support of an application or petition must include complete translation into English. In addition, there must be a certification from the translator indicating that the translation is complete and accurate and attesting to his or her competence as a translator. See 8 CFR 103.2(B)(3)." - bolded by me

You can have any person who can attest being a translator from Thai to English have it translated for you. It could even be your wife do it. I've read in other threads that people have done it in the past and have had no problems. Another option would be asking your wife to translate it and ask someone you know who is fluent in both Thai and English to certify it as being accurate as per USCIS's instructions.
