I would like to honestly fill out the G 325A with all my past work history, but I am afraid to put this one time that I worked 2 months past my EAD expiration. Since I have an L2 (wife of L1), and we had to renew our visas abroad, the only time we realized that my EAD expired was shortly after we left the US. But even when I resigned from work, my W2 still shows that I got paid for the 2 month when technically I am not allowed to work anymore. Would this be a big problem now my husband and I are applying for an adjustment of status / green card (employment)? Thanks very much!

Shouldn't be an issue - but don't lie.

If you "forget" to list it, and they happen to come across your W-2 somehow, they may go "oh look, misrepresentation..." and deny the AOS.

They forgive a lot of things, but misrepresentation, not so much...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

They forgive a lot of things, but misrepresentation, not so much...

well bobby `they forgive a lot of things`, yes it's true lol, when the time comes we're gonna be putting that info on my G325a form too.

@elgina go and search for my posting `before I apply for my green card` I asked the same question, I have worked over 3 years under w2/w4, and apparently under the immigration act law, it is forgiven upon marriage to USC. Information was very helpful from the people here. I would never think of not providing the info!

Thanks, Bobby and Vkn! Yes, my situation was a little unclear compared to the other individuals who married USCs. In my case, my husband was applying for for the greencard and I am applying for the I485/G325A as his spouse. So although the other guys who had overstayed or worked illegally were forgiven, I am not too sure that this applies to us since both myself and my husband are still in the process of applying for the green card.

would you guys think that I it would be better that I don't omit this information totally, and just put in the dates that I worked for the company while my EAD was still valid (but omit the last 2 months when I worked with an expired EAD)? We just totally forgot that my EAD expires a few months before our L1/L2 expires, and the company I worked for did not bother to check it, too. Once I realized this, I stopped working and have not worked since.

Your situation is pretty tough and working without authorization will be punished. May be they won't notice but I don't suggest to hide it. They can see through social security your work periods and you will be in more troubles than letting them know.

If they ask just apologize and explain everything.

I wouldn't reckon saying `i forgot that i didn't have authorization` yes this is an honest mistake but... back in the time, I was out of status from my F1 student visa, because of an honest mistake, it took a 2 court dates and almost a year to reinstate my status, hired a lawyer and everything.

They would say it is your responsibility to know, you could say `you needed the income` to live basically, paying rent and bills and such. I don't think this will be a problem.
