Hi all

Recently submitted full AOS package, with checks for: I-130 $355. I-765 $340.00 and I-485 $1010.00.

I have received all NOA receipts for the above yesterday.... no problem there.

However, today I receive another NOA "rejection notice" that says...

Recently you submitted an application for immigration benefits. That form was submitted with extra remittance that is not required to process your application, or the incorrect fee was submitted. Your check is being returned to you with this notice. No additonal aciton by you is required at this time.

Sounds simple enough, I paid too much and they returned a check for $340 for the I-765. ( i raised seperate checks for all the forms).

Couple of observations though.

1. The receipt number on this NOA refers to the I-485 and not the I-765.

2. And why does it say "rejection notice"

3. Do I have to refile the I-765, when I read the notice, clearly says no action required - but it is a rejection notice.

Any help ..... Spoke to an attorney who is looking into, she did confirm that she has seen a few of these recenlty, and there was no need to refile. However, non of those had "rejection notice typed on them" but had the same text about the check being returned.

It was rejected because you paid extra $340 for I-765. When you filed I-485, if you read the instructions thoroughly, the amount of $1,010 basically covers EAD and AP, if you wish to work and/or to leave the country for special purposes while you're not approved yet. That's why the check was returned to you.

Since you received all NOAs, you shouldn't worry about it. No action required, like the notice says.

Yes! I am approved!!! :)

It took only two (2) months to be approved. Hooray!

Timeline

December 5, 2009 - I-485 application was submitted.

January 12, 2010 - I-485 application was re-submitted due to address error.

January 20, 2010 - I-485 application receipt notice arrived.

January 25, 2010 - Biometrics notice arrived.

February 9, 2010 - Biometrics taken at local USCIS office.

March 5, 2010 - Initial Interview notice arrived.

April 15, 2010 - Employment Authorization Card arrived out of blue.

April 29, 2010 - Initial Interview scheduled and... APPROVED!!! :) Conditional GC will arrive in 2-3 weeks.

April 30, 2010 - SSN reactivated. Newly printed card will arrive in 3-5 days.

May 7, 2010 - Welcome Notice arrived! Hooray! :)

May 8, 2010 - Freshly printed SSN card arrived.

May 26, 2010 - Conditional GC issued.

June 1, 2010 - Conditional GC ARRIVED! Yippee! :)

June 2, 2010 - SSN upgraded. Newly printed card will arrive in a week.

June 9, 2010 - Freshly printed SSN arrived.

October 10, 2011 - I-751 petition was submitted.

October 18, 2011 - I-751 petition was returned. It turned out to be USCIS's error sending it back to me.

October 19, 2011 - I-751 petition was re-submitted.

October 26, 2011 - I-751 petition receipt notice arrived.

November 18, 2011 - Biometrics taken at local USCIS office.

December 27, 2011 - I-751 petition Approval letter was issued.

December 28, 2011 - I-751 petition Approval letter arrived

December 29, 2011 - GC was issued.

December 30, 2011 - GC arrived.

Thanks for that, to substiante your views, just realized that the date on the check return NOA was 21st April. The date on the three receipt NOA's is 25th April, they arrived in reverse order. If that makes sense.

Everything on the three NOA's seems correct and ok....biometric tests ect.....
