Correct me if I'm wrong but I thought adoption for the purpose of immigration is considered fraud.

I mean, if you adopt and orphan or a family member who has been orphaned, abandoned etc then need to have them immigrate so you can care for them is okay but if they're in no immediate danger or risk in their current situation you can adopt them & then petition them.

Yes of course the child must be an orphan or has parent (s) that is either absent or cannot function as parents and that is why I said there's bunch of requirements about adoption but I leave it to the OP to find out what are those. Adoption is for children who cannot be reared by their biological parents.

The OP did not state if the parents are still alive or not. She only said she want to bring over her nephew which is impossible to do since he is not an immediate family.

I'm not suggesting an adoption for purpose of immigration. Adopting her nephew is only her option if she really wants him to come over sooner provided the child qualifies the requirements that I have mention.

We need more info from OP if the child's parents are still around or not or the parents have voluntarily or involuntarily forego their parental authority to the child.

many asian languages in verbal form use the same sound for male relative as that for female relative. in chinese there is a different written character, but the sound is the same. this extends to the pronouns "him" and "her", so you will often hear a chinese use the word "he" when talking about a female.
