Hello,

I have a question regarding DS-230 form question number 31a where they ask about who will be accompanying the applicant to the United States now. I have applied for my mother and my 2 brothers for green cards but only my mother's application has come this far. I was wondering if I could bring the rest of my family through my mother's application.

Question number 31 a. asks to list "Persons named in 14 to 29 who will accompany you to the United States" - if I put my father and my two brothers' names, does this mean that they too will be eligible for a green card or is that solely for information purposes? If I list their names there, do I have to provide the same documentations they ask for my mother such as birth certificate, marriage certificate, etc? Please explain the purpose of that question and how does that differ with 31 b. One of my brother is already in the US on student visa but I want to include him on the application if that will get him a green card.

No, there are no derivatives in your mother's case, she is the only one coming (IR). Even if you did put down your father and brother's information it won't make a difference. So 31a and 31b do not apply in her case. You have to remember, this form is used for all types of immigrant categories and not all questions will apply.

Did you submit a petition for your father? He'd be under the IR category and could be done with everything in around 12 months.

If you have submitted petitions for your brothers (F4), they will still have to wait for the visa number to become available to them before they can become permanent residents. In most cases the wait time is between 10 to 24 years.
